NetSuite Inc. (“NetSuite”) receives personal information from the EU as follows: (i) NetSuite hosts and processes business data, which may include personal information, received from registered customers through password-protected webpages that require customers to log in, (ii) NetSuite collects personal information through its freely accessible websites, and (iii) collects and stores personal information from NetSuite employers and service providers in the EU. Data from Customers. For registered customers, NetSuite processes (1) contact, account and billing information that customers actively submit to NetSuite (“Relationship Data”), and (2) any data that the customer enters into the NetSuite hosted technology platform, i.e., the accounting, financial, customer relationship management, human resources and other business data for which the customer uses the services (“Hosted Business Data”). NetSuite stores Hosted Business Data at the customer’s initiative, direction and control. The customer uses and processes the Hosted Business Data through the NetSuite service. NetSuite uses and processes Relationship Data to market, provide, improve and charge for NetSuite services and as otherwise required or permitted by any applicable service or license agreement with the customer. Outside the scope of NetSuite’s Safe Harbor registration, NetSuite also stores and uses personal information collected through its publicly accessible website in accordance with the NetSuite Website Privacy Policy posted on the website; the publicly accessible portions of the NetSuite home page are only covered by NetSuite’s Website Privacy Policy and not by the Safe Harbor – as further explained in detail in NetSuite’s Website Privacy Policy ( and NetSuite’s General EEA Safe Harbor Notice ( Data from Employees. NetSuite receives and processes a number of different categories of EEA Employee Data: name, job title, birthdate, gender, marital status, employee identification number, workplace contact information, reporting line, education/qualification, credentials, work history, professional achievements and awards, salary, stock option information, compensation history, performance/work history, and information regarding an EEA Employee’s spouse, family members or other dependants and beneficiaries for emergency contact and benefits administration purposes.
